Acceptance of these Terms

By downloading, installing, or using Elixira (the "App"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms form a binding agreement between you and Hyperture Technologies ("we", "us", "our").

If you do not agree to any part of these Terms, do not use the App.

Eligibility

You may use Elixira only if:

• You are at least 18 years old
• You can form a legally binding contract under the laws of your country
• You are not barred from using the App under any applicable laws
• You will use the App only for lawful, personal, non-commercial purposes

By creating an account, you confirm that all of the above are true.

Your account

• You agree to provide accurate, current, and complete information
• You are responsible for keeping your password confidential
• You are responsible for all activity that occurs under your account
• Notify us immediately at support@elixira.app if you suspect unauthorised access
• You may have only one account — accounts may not be shared, transferred, or sold

Free trial and subscription

7-day free trial

New users receive a 7-day free trial with full access to all features. No payment information is required to start the trial. Cancel at any time during the trial at no cost.

Subscription plans

• Monthly — US$4.99 per month
• Yearly — US$49.90 per year (equivalent to $4.16/month — 2 months free vs monthly)

Prices may vary by region and are subject to change. Any change will be communicated in advance and will not affect your current billing period.

Billing and renewal

Subscriptions are billed through Google Play. Payment is charged at confirmation of purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel at play.google.com/store/account/subscriptions.

Cancellation and refunds

Cancel anytime — you retain access until the end of your paid period. We do not provide pro-rata refunds for partial periods. Refund requests are governed by Google Play's refund policy.

Acceptable use

You agree not to:

• Use the App for any unlawful, fraudulent, or harmful purpose
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Use automated tools to access or scrape the App
• Attempt to bypass paywalls, security measures, or rate limits
• Use the AI Coach to generate content that violates Anthropic's usage policies or applicable law
• Resell, sublicense, or share access to the App or your account
• Interfere with the proper functioning of the App or its underlying services

Licence to use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, for personal non-commercial use only.

This licence does not transfer any ownership of the App. All intellectual property — including design, code, branding, written content, AI prompts, and the name "Elixira" — belongs to Hyperture Technologies or its licensors.

Your content

Journal entries, habits, goals, bucket list items, check-in data, and anything else you create in the App ("Your Content") remains your property. By submitting it, you grant us a limited licence to store and process it solely to provide the App to you. We do not use Your Content for any other purpose, do not sell it, and do not share it for advertising.

Mental health and wellbeing

No warranties

The App is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, Hyperture Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the App.

Our total liability for any claim will not exceed the greater of (a) the subscription fees you paid us in the 12 months preceding the claim, or (b) US$50.

Nothing in these Terms excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.

Indemnity

You agree to indemnify and hold harmless Hyperture Technologies and its personnel from any claims, damages, or expenses arising from your breach of these Terms, misuse of the App, or violation of any law or third-party rights.

Termination

You may stop using the App and delete your account at any time from the Me screen. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. On termination, your right to use the App ceases immediately. Provisions that should survive (disclaimers, liability limits, indemnity, governing law) continue to apply.

Changes to these Terms

We may update these Terms from time to time. For material changes we will notify you by in-app message or email. Continued use of the App after an update constitutes acceptance.

Third-party services

The App uses third-party services including Google Play, Anthropic, Supabase, RevenueCat, OneSignal, and Resend. Your use of those services is subject to their own terms. We are not responsible for the acts or omissions of third parties.

Governing law and disputes

These Terms are governed by applicable law. We aim to resolve any dispute informally first — contact us at support@elixira.app and we will work to find a fair resolution within 30 days.

If a dispute cannot be resolved informally, it shall be referred to binding arbitration under internationally recognised arbitration rules. Nothing in this clause prevents you from bringing a small-claim or consumer-protection action in the courts of your country of residence where local law provides for such a right.

Consumer rights

If you are a consumer in the US, UK, EU, or any other jurisdiction with mandatory consumer protection laws, nothing in these Terms limits your statutory consumer rights or your right to bring proceedings in your local courts.

General

• Entire agreement — these Terms and the Privacy Policy constitute the complete agreement between you and us
• Severability — if any provision is unenforceable, the rest continues to apply
• No waiver — failure to enforce a right is not a waiver of that right
• Assignment — you may not transfer your account or these Terms; we may transfer our rights to a successor
